Version 1.1.
1. Our position
Creators own their content and we respect the copyright of everyone else. We respond to notices under the Digital Millennium Copyright Act (17 U.S.C. §512) and equivalent laws, and we remove or disable access to infringing material when properly notified.
2. Designated agent
Notices should be sent to our designated copyright agent:
Copyright Agent, Eroamora LLC
Eroamora LLC
New York, NY 10001, United States
eroamora.com@gmail.com
Or use the report form and choose "Copyright", which collects everything below.
3. What a notice must contain
- Identification of the copyrighted work you say has been infringed.
- The exact address of each item on this platform you want removed.
- Your name, address, telephone number and email address.
- A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for the owner.
- Your physical or electronic signature.
Notices missing any of these may not be acted on. Knowingly misrepresenting that material is infringing exposes you to liability for damages under §512(f).
4. What we do
Every notice is acknowledged with a reference number on receipt, read by a person, and acted on promptly — usually within two business days. Where we remove material we tell the Creator, give her a copy of the notice, and explain how to contest it.
5. Counter-notice
A Creator who believes material was removed by mistake or misidentification may send a counter-notice containing: identification of the material and where it appeared; a statement under penalty of perjury that she has a good-faith belief it was removed by mistake or misidentification; her name, address and telephone number; consent to the jurisdiction of the federal court for her address (or, if outside the United States, for our address) and to accept service from the person who sent the notice; and her signature. We forward it to the complainant, and unless they tell us within ten business days that they have filed a court action, we may restore the material after ten and before fourteen business days.
6. Repeat infringers
An account that receives valid notices on more than one occasion is terminated. A single notice concerning many items counts as one occasion; a notice we determine to be invalid or withdrawn counts as none.
7. Creators' own work
If your content appears elsewhere without your permission, we will help you send a notice to that site. Write to eroamora.com@gmail.com.
